Appeal court has dismissed a suit by the Allied Peoples Movement, APM, seeking to disqualify the Labour party presidential candidate, Peter Obi from the February 25th general election.
In the appeal marked: CA/ABJ/CV/1414/2022, APM said that the Independent National Electoral Council (INEC) was not supposed to recognise Peter Obi as a valid presidential candidate cos his defection from the People’s Democratic Party (PDP) is in violation of sections 77(2) and (3) of the Electoral Act, 2022.
The movement argued that Peter Obi joined Labour party after the party had already sent a list of its registered members to INEC so Obi lack the right to be recognized as the Labour Party flagbearer because his name was not on the list of registered party members LP sent to INEC.
The panel, which was led by the President of the Court of Appeal, Justice Monica Dongbam-Mensem, Justice Danlami Senchi and Ugochukwu Ogakwu ruled that there was no merit in the appeal filed by APM.
The appellate court noted that Peter Obi resigned from PDP on the 24th of May 2022, and INEC published his name as a candidate for the LP on the 20th of September 2022, while the APM, filed its suit on the 30th of September 2022, after the publication of Obi’s name.
The court consequently struck out the suit and awarded the sum of 200,000 naira each to Peter Obi and Labour party.
