The Federal Government of Nigeria has on Thursday approved the United States of America’s request for the extradition of a suspended Deputy Commissioner of Police (DCP) Abba Kyari over his involvement in a $1.1 million fraud committed by a popular Instagram celebrity and fraudster, Abass Ramon aka Hushpuppi and four others.
This was declared by Abubakar Malami (SAN), the Attorney-General of the Federation and Minister of Justice (AGF), after filing an application before the Chief Judge of the Federal High Court in Abuja for the extradition of the suspended and disgraced police chief. The application filed by Malami is marked: FHC/ABJ/CS/249/2022 under the Extradition Act.
Recall that in April 2021, a jury filed an indictment against Kyari with the approval of the U.S. District Court and demanded Kyari stand trial for conspiracy to commit wire fraud, money laundering and identity theft.
Malami noted that the application was put into consideration following a request by the Diplomatic Representative of the U.S. Embassy in Abuja. He stressed that the request is basically to capitulate Abba Kyari, who is involved in a superseding three counts indictment.
The AGF stressed that he was satisfied that the offence which led to the surrender of the suspended police chief is not political nor it is trivial.
He reiterated his satisfaction that the request for the Kyari’s surrender was in good faith as well as the interest of proper justice, not to persecute or punish him due to his race, religion, nationality or political opinions. In his words:
“If surrendered, will not be prejudiced at his trial and will not be punished, detained or restricted in his personal liberty, by reason of his race, nationality or political opinions”.
Malami said further that the decision of the government will not be unjust, or be too severe a punishment, to surrender him, considering all the circumstances of the offence he committed. He added that he was also satisfied that Kyari has been accused of the offence for which his surrender is sought.
The AGF noted that there was no criminal proceeding pending against the suspended DCP in Nigeria for the same offence.
With this new development, the disgraced and suspended DCP would be taken to the United State to face his trial alongside his partner, Hushpuppi who is awaiting his own verdict soon.
Abba Kyari is presently in the National Drug Law Enforcement Agency (NDLEA) custody over his involvement in another offence relating to a 25kg cocaine deal with an international drug cartel.
