Again, Abba Kyari’s Bail Application Declined

DCP Abba Kyari, the suspended Super Cop who has been in the net of the National Drug Law Enforcement Agency, NDLEA, has been denied bail for the second time by the Federal High Court sitting in Abuja.

Abba Kyari has told the court that he is suffering from diabetes and hypertension and needed to be released to seek medical attention.

Kyari has approached the court on February 21, through his counsel, to to seek bail for further treatment.

However, the presiding judge, Justice Inyang Ekwo, denied him bail in a ruling on Monday. The judge held that Kyari’s application has been overtaken by events following an order of another High Court granting the NDLEA’s prayers to detain Kyari for another 14 days to enable it conclude its investigation.

Justice Ekwo held that the court, which gave NDLEA a favourable order on February 22, is a court of coordinate jurisdiction; and such order could not be overuled.

Speaking further, the judge affirmed that he was now inclined to hear, with the urgency it deserves, the fundamental enforcement rights suit that Abba Kyari has instituted against the Drug Enforcement agency after the expiration of the 14-day court order.

He thereafter adjourned the hearing until March 15, when the 14 days would have lapsed, to hear Kyari’s application for his fundamental right enforcement.
